The Purpose

Provide parishes and schools(Entity) with a step-by-step process for responding to opportunities to acquire property either through purchase or donation.

Purchase/Donation Acceptance of Property

STEP 1 - 1st Request for Approval

Written request for approval from the Archbishop to investigate the purchase/donation.

Information to include:

  • Description, location, and size of the property
  • Current owner
  • The Entity’s intended use for the property
  • Estimated cost and timing of the transaction
  • How the purchase will be funded (current savings, capital campaign, archdiocesan loan)
  • Attach information required by the Archdiocesan Large Capital Project Process if applicable. All forms listed below are found under FORMS on the CCSI Resources webpage:

STEP 2

After the Archbishop’s Approval, contact Catholic Construction Services, Inc. (CCSI) to coordinate the next steps:

  • CCSI performs a cursory inspection of the property
  • Entity and CCSI will discuss the terms of the contract (Purchases will require approval by the Project Review Committee and contracts will need to include contingencies stating that fact.)
  • Entity negotiates the terms of the acquisition with the seller or donor
  • Entity determines if offer should be made

STEP 3 - 2nd Request for Approval

Written request for approval from the Archbishop:

  • to submit an offer to purchase/accept the property
  • to conduct due diligence
  • to draft required legal documents

Information to include:

  • Description, location, and size of the property
  • Current owner
  • The Entity’s intended use for the property
  • Offer price
  • How the purchase will be funded (current savings, capital campaign, archdiocesan loan). Not required for donated property
  • Attach information required by the Archdiocesan Large Capital Project Process if applicable

STEP 4

After the Archbishop’s Approval, CCSI will arrange for the professional services required to draft a Contract to Purchase the property or to accept the donated property and conduct all the Due Diligence† steps required by Archdiocesan procedures. The Due Diligence includes, but is not limited to, the following:

  • Boundary Survey (ALTA Survey)
  • Professional Property Appraisal (MAI Appraisal with large acquisitions)
  • Property Inspection
  • Phase I Environmental Impact Study (if needed)
  • Legal expenses for drafting contract and related documents
  • Title search and Title policy
  • Zoning change or Special Use Permit if necessary
  • Hazardous Materials inspection (lead paint, asbestos, radon)
Please Note:

All costs to investigate the purchase or donation of property and any subsequent due diligence and legal fees are the responsibility of the parish or school whether a transaction is completed or not. CCSI will provide an estimate of due diligence work to the parish or school before it is initiated.

STEP 5

CCSI will finalize the transaction details with Entity. The required documents will be executed by the Archbishop and submitted to the seller.
